EyeTell Privacy Policy
Last Updated: April 9, 2026
This Privacy Policy applies to EyeTell’s website, web-based application, desktop and mobile applications, community platform, along with all related components, features, updates, upgrades, services, support, sales, and marketing activities (collectively, the “Services and Software”).
1. Who We Are and Permitted Accounts
EyeTell, Inc., located at 400 Concar Drive, San Mateo, California 94402, is responsible for the collection and use of personal information described in this Privacy Policy.
EyeTell does not permit account registration by individuals who are habitually resident in jurisdictions designated as “Restricted Regions” in the EyeTell Terms of Service, which currently include the European Economic Area (EEA) and the United Kingdom. Individuals whose habitual residence is outside such Restricted Regions (“Global Users,” as defined in the Terms of Service) may register for and use the Services and Software in accordance with the Terms of Service.
Global Users may access and use their accounts while temporarily located in a Restricted Region. In such circumstances, EyeTell may continue to collect, use, and process personal information as described in this Privacy Policy, including account information, device data, and usage activity, for the purposes of providing the Services and Software, maintaining security, enforcing eligibility restrictions, and ensuring service functionality. Temporary presence in a Restricted Region does not, by itself, change the nature of EyeTell’s role or data processing practices as described in this Privacy Policy and the Terms of Service. You must not misrepresent your location or use a VPN, proxy, or location-spoofing tool to evade geographic or eligibility controls.
2. Notice at Collection for California Residents
EyeTell collects several categories of personal information, including identifiers, commercial information such as “Tube” transactions, internet or network activity, and User Content (as defined in the Terms of Service) to the extent that it identifies, relates to, or could reasonably be linked to a specific individual. This information is used to provide our AI-powered film-making Services and Software, to process payments, and to ensure the security and integrity of our platform. EyeTell does not sell your personal information. However, we may share personal information with third-party AI model providers solely as service providers or contractors to perform Services and Software on our behalf, subject to our Terms of Service. Personal information is retained for as long as your account remains active and thereafter as required or permitted by applicable law, including retention periods of up to seven years for financial records. You may opt out of the sharing of your personal information by using the “Do Not Sell or Share My Personal Information” link available on our website or by contacting us at [email protected], provided that your account may be terminated if opting-out renders the Services and Software inoperable.
EyeTell does not use or disclose sensitive personal information for purposes that would require a “Limit Use of Sensitive Personal Information” right under California law.
3. Categories of Personal Information We Collect
EyeTell collects personal information necessary to provide its Services and Software. This includes identifiers such as your name, email address, username, IP address and device identifiers, and AI-related inputs, instructions, prompts, or outputs. We, and our payment processors, also collect commercial information related to subscriptions, billing transactions, and the purchase and use of “Tube” credits. We collect internet and network activity information, including usage logs, feature interaction data, and session diagnostics.
In addition, we process User Content (as defined in the Terms of Service) such as videos, prompts, scripts, images, audio files, metadata, and generated outputs. Where provided, we may collect professional information such as company affiliation or role, and we may derive limited inferences regarding usage preferences and engagement patterns.
EyeTell may derive approximate geolocation from your IP address and limited device signals, including device type and configuration, in order to enforce geographic restrictions, maintain security, and prevent fraud. EyeTell does not engage in cross-site tracking or behavioral profiling.
4. Sources of Personal Information
Personal information is collected directly from you when you create an account, use the Services and Software, or communicate with us. We also collect information automatically through your interaction with our Services and Software, including device and usage data. In addition, we receive information from third-party service providers such as payment processors, analytics providers, and AI model providers, as well as from publicly available or legally permitted commercial sources.
We may also receive personal information about you from other users of the Services and Software who invite you to collaborate. This may include your name, email address, and related invitation metadata necessary to send an invitation and facilitate account registration and collaboration features. If you believe your personal information has been provided to EyeTell without your authorization, you may contact us at [email protected] and we will take appropriate steps to address the request.
5. How We Use Personal Information
EyeTell uses personal information to provide its Services and Software, including enabling account functionality, generating AI-based outputs, processing payments, and facilitating collaboration features. We also use personal information to maintain the security and integrity of the Services and Software and enforce our Terms of Service. We analyze usage patterns and system performance to improve our products and user experience. We may use IP address, device identifiers, and other geolocation signals to determine regional access eligibility and enforce geographic restrictions.
Providing certain technical information, such as IP address and device signals, is necessary to provide the Services and Software. Without such information, the Services and Software may not function properly. Where permitted by law, EyeTell may communicate with you regarding service updates, support requests, and product-related information. EyeTell may display advertising, sponsored content, or promotional materials within the Services and Software. Where such features are implemented, EyeTell may use limited personal information such as account information, device data, and general usage activity to deliver, measure, and improve such content. EyeTell does not use advertising tracking technologies except as permitted by applicable law.
6. Generative AI and Third-Party Model Providers
EyeTell utilizes third-party generative artificial intelligence engines to provide its cinema-generation features. By using the Services and Software, you acknowledge and agree that your inputs, including prompts and uploaded media, will be shared with and processed by these model providers in order to generate outputs. These providers may change from time to time to ensure the quality and performance of the Services and Software. Your use of AI-powered features constitutes acceptance of the applicable policies and terms of such providers. EyeTell’s AI model providers contractually provide that they do not use private user content to train their foundational models. EyeTell will ensure that third-party partners authorized to process personal data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality. We may, however, use de-identified or aggregated service interaction data to improve the Services.
7. Social Features and Content Visibility
EyeTell includes collaboration and community features that allow you to share content with others. Content shared through these features may be visible to collaborators or other users, depending on user actions and settings. Due to technical constraints such as backups and caching systems, certain content may persist in limited form even after deletion. You should exercise caution when sharing personal information. If you invite another person to collaborate through the Services and Software, we may collect and process that person’s name, email address, and related invitation metadata as necessary to provide the collaboration feature. By submitting another person’s contact information, you represent that you have the authority to do so and to permit EyeTell and its service providers to use that information to send the invitation, facilitate account registration tied to the invited email address, and support collaboration features. If the invited person registers, we will process their information in accordance with this Privacy Policy.
8. Cookies, Tracking, and Communications
EyeTell uses cookies and similar technologies to maintain sessions, enable core functionality, and improve service performance. EyeTell does not use advertising tracking technologies except as permitted by applicable law. Emails sent by EyeTell may include tracking technologies to measure engagement, and you may opt out of marketing communications at any time. Please review our Cookie Policy here.
9. Software Activation and Device Information
EyeTell collects information about your device and software usage, including device identifiers, software version, activation status, and performance logs. This information is used to ensure licensing compliance, maintain system integrity, and improve service reliability. For users of Apple platforms, EyeTell maps its data practices to Apple’s privacy disclosure categories, including data linked to the user such as contact information, identifiers, purchases, and user content. EyeTell does not use personal data to track users across third-party applications without explicit opt-in.
10. Disclosure of Personal Information
EyeTell discloses personal information to service providers that process data on its behalf, including providers of cloud infrastructure, artificial intelligence services, payment processing, analytics, and security. EyeTell may also disclose personal information to organizations and their Authorized Users (as defined in the Terms of Service), where accounts are created using an organization-controlled email domain or are otherwise associated with an organization, for purposes of account administration, billing, and management of organizational use of the Services and Software. Personal information may be disclosed to regulators, courts, or law enforcement authorities where required by law, and in connection with mergers, acquisitions, or other corporate transactions.
11. Data Retention
EyeTell retains personal information only for as long as necessary to provide the Services and Software, comply with legal obligations, enforce its Terms of Service, and maintain platform integrity. Transaction records, including those related to “Tube” purchases and usage, are retained for a period of seven years to comply with financial and tax obligations. While the right to use a Tube credit expires one year after purchase, metadata associated with that transaction may be retained for the duration of the account to resolve billing disputes.
If you delete content or your account, we will delete or de-identify information within a reasonable timeframe, subject to residual copies that remain in backups, caches, or logs until overwritten. We may retain personal information longer where necessary to detect fraud, protect rights and safety, or comply with tax and legal obligations.
12. Data Security
EyeTell implements administrative, technical, and organizational safeguards designed to protect personal information. These measures include encryption in transit, access controls, system monitoring, and incident response procedures. Despite these efforts, no system can be guaranteed to be completely secure.
13. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, or delete your personal information, or to opt out of certain uses of your personal information. EyeTell verifies all requests to protect user security, typically by confirming identity through the email address associated with the account. Where requests are submitted through authorized agents, EyeTell requires proof of authorization and may verify identity directly with the user. These rights may be subject to limitations under applicable law, including where fulfilling a request would adversely affect the rights of another individual or where EyeTell is required to retain information for legal, regulatory, security, or contractual purposes.
EyeTell respects the privacy of individuals whose personal information or likeness may appear in User Content or generated outputs. If you find your personal information in content created or uploaded by another user without your authorization, you may submit a request for removal. To take action, EyeTell must determine that you are uniquely identifiable in the content. This means the content identifies, relates to, or could reasonably be linked to you through your face, voice, full name, or other specific identifiers. This process applies equally to AI-generated outputs, including synthetic media that realistically depicts your likeness or mimics your unique persona. Requests for removal must be sent to [email protected] and include sufficient detail for EyeTell to locate the content and verify your identity. Upon receiving a valid request, EyeTell may notify the user who uploaded or generated the content to provide them an opportunity to remove, blur, or edit the identifying information. If the content is not resolved by the uploader, EyeTell will review the request. We consider various factors, including the context of the content, whether it is a matter of public interest, and the rights and safety of other individuals. EyeTell may decline a removal request where the information is used for legal, regulatory, or security purposes, or where its removal would adversely affect the rights of others.
14. Marketing and Consent
You may opt out of receiving marketing communications at any time. Where processing is based on consent, you may withdraw consent at any time without affecting the lawfulness of prior processing.
15. Children’s Privacy
EyeTell Services and Software are intended for individuals aged 18 and older. EyeTell does not knowingly collect personal information from children.
16. Changes to This Policy
EyeTell may update this Privacy Policy from time to time to reflect changes in technology, law, or business practices. Where required, you will be notified of material changes.
